Zone Schedule

A 'Zone Schedule' has been prepared by the Moses Lake Public Corporation (Port of Moses Lake), in its capacity as the Grantee of Foreign Trade Zone #203. It has been prepared in accordance with 15 C.F.R. 400.42 and is on file with the Foreign Trade Zones Board, the United States Customs Service in Moses Lake and the Port of Moses Lake administrative office.

Fee Schedule

The following fees are charged by the Port of Moses Lake as Grantee per Tariff Fee Schedule No. 6 (Effective 10/13/2003):

One-Time Application/Request Processing Fees

I. FEE FOR EXPANSION OF GENERAL PURPOSE FTZ TO INCLUDE ADDITIONAL PROPERTY:

Application to be prepared by the applicant with Port Sponsorship. - $9,900

II. FEE FOR SUBZONE DESIGNATION

Application to be prepared by the applicant with Port Sponsorship. - $9,900

III. FEE FOR FTZ MANUFACTURING/PROCESSING REQUEST AT EXISTING FTZ SITE (GENERAL PURPOSE AND/OR SUBZONE):

Request to be prepared by the applicant with Port Sponsorship. - $9,900

IV. FEE FOR MINOR MODIFICATION OF EXISTING FTZ SITE (GENERAL PURPOSE AND/OR SUBZONE):

Request to be prepared by the applicant with Port Sponsorship.

The above non-refundable fees are payable by the applicant to the Grantee prior to the submission of the application or request to the Foreign-Trade Zones Board. Failure by the applicant to pay such fees to the Grantee will result in the Grantee withholding approval of the application or request and the Grantee refusing to file application or request on behalf of the applicant. - $9,900

V. FEE FOR ACTIVATION OF GPFTZ/SUBZONES:

Application to be prepared by the applicant with Port Sponsorship.

The above non-refundable fee is payable by the applicant to the Grantee prior to the submission of the activation application to the United States Customs Service. Failure by the applicant to pay such fee to the Grantee will result in the Grantee withholding its concurrence to the activation.

Annual Fees for Non-Activated Foreign Trade Zone Sites

I. ANNUAL FEE FOR NON-ACTIVATED SUBZONES:

The above non-refundable Annual Fee is payable by the Operator to the Grantee upon the issuance of the Grant by the Foreign Trade Zones Board authorizing the establishment of the subzone. If said site is activated as a subzone within one year from the issuance of the Grant, the operator will pay the Grantee an additional amount to bring the total up to the amount for the Annual Fee for 'activated' Subzones. The Annual Fee For Activated subzones will by paid on the anniversary date of said activation every year thereafter that the site remains activated. Should said site be deactivated as a subzone, the Operator will commence paying the Grantee the nonrefundable Annual Fee for Non Activated Subzones on the anniversary date of the original activation. - $9,900


II. ANNUAL FEE FOR OWNERS OF NON-ACTIVATED GENERAL PURPOSE FTZ (GPFTZ) SITES:

The above non-refundable Annual Fee is payable by the Property Owner of a GPFTZ Site to the Grantee within 90 days of the designation of the property by the Foreign Trade Zones Board as part of FTZ #203, unless any part of the site is activated during the 90 day time period. The Annual Fee will by paid on the anniversary date of the zone designation every year thereafter that the site remains non-activated. This Annual Fee is suspended should any part of the site be activated and remains suspended until the entire site is non-activated, at which time the Property Owner will commence payment of the Annual Fee on a yearly basis. - $9,900

III. ANNUAL FEE FOR OPERATORS OF NON-ACTIVATED GPFTZ SITES:

The above non-refundable Annual Fee is payable by the Operator of a GPFTZ Site to the Grantee within 90 days of the date of the execution of the Grantee/Operator Agreement, unless any part of the site is activated during the 90 day time period. The Annual Fee will by paid on the anniversary date of the execution of the Agreement every year thereafter that the site remains non activated. This Annual Fee is suspended should the site be activated and remains suspended until the site is non-activated, at which time the operator will commence payment of the Annual Fee on a yearly basis.

A Property Owner, which also functions as the Operator of a non-activated GPFTZ Site, will not be subject to both Fees II and III, but only to Fee II.

Annual Fees for Activated Foreign Trade Zone Sites

I.

ANNUAL FEE FOR General purpose FTZ (GPFTZ) operator/user engaged in manufacturing/PROCESSING AND/OR NON-MANUFACTURING/NON-PROCESSING ACTIVITIES WITHIN ACTIVATED PORTION OF GPFTZ #203

III.

ANNUAL FEE FOR GPFTZ OPERATOR WITH USERS ENGAGED IN NON-MANUFACTURING/ NON-PROCESSING ACTIVITIES WITHIN ACTIVATED PORTION OF GPFTZ #203 (FEE IS SAME REGARDLESS OF NUMBER OF USERS)

IV.

ANNUAL FEE FOR GPFTZ OPERATOR WITH USERS ENGAGED IN MANUFACTURING/PROCESSING ACTIVITIES WITHIN ACTIVATED PORTION OF GPFT2 #203 (FEE IS PER USER):

The above non-refundable Annual Fees are payable by the Operator to the Grantee upon the activation of the foreign-trade zone site (GPFTZ or subzone) and on the anniversary date of said activation every year thereafter that the site remains activated.

A GPFTZ Operator with multiple Users engaged in both non-manufacturing/non-processing activities and manufacturing/processing activities will be subjected to Fee III  covering all non-manufacturing/nonprocessing users, plus Fee IV for each non-manufacturing/nonprocessing User.
